Abstract

This text sets out to examine the implications of the power to design life which the application of genetics to reproductive biology has brought about. It aims to create a dialogue between human genetics and psychology, law, philosophical and theological ethics. The text explores the contribution of modern genetics to human self-understanding and health care, genetic and psychological factors in shaping personal identity, cloning, changes in the concept of parenthood, the moral status of the human embryo and the legal and political issues from biotechnology.

Qu’est-ce qu’un embryon ? Un être humain à part entière ? une « personne potentielle » ? une simple promesse d’humanité ? un matériau prodigieusement riche et susceptible d’être utilisé pour le bien des humains achevés que nous sommes ? Ces questions qui taraudent notre époque, l’homme se les pose depuis des millénaires. Ce sont bien les mêmes questions, même si l’outillage conceptuel a changé. Quand l’embryon devient-il un être animé ? à la conception, au cours de la gestation, à la naissance ? quelle sorte d’âme doit-on lui reconnaître ? végétative, animale, rationnelle, spirituelle ? d’où vient cette âme ? de la semence, de Dieu, du cosmos ? quelles exigences éthiques en découlent pour nous ? Héritant des spéculations des philosophes grecs et de la révélation des Ecritures juives, les chrétiens des premiers siècles ont apporté une contribution originale à cette réflexion, sans éluder les problèmes sans fin que pose l’un des plus grands mystères de notre existence humaine : son surgissement dans un ventre de femme. Le statut de l'embryon humain est une des grandes questions débattues actuellement. Pour alimenter le débat, ce recueil rassemble des textes patristiques majeurs.Dans son introduction, M.-H. Congourdeau montre avec clarté les réponses que les Pères dans la foi ont apportées à ce débat qui affleure dans la Bible et que les philosophes de l'Antiquité ont déjà largement entrepris. La solution de Platon a faussé la pensée d'Origène sur l'âme, son origine et sa fin. La position stoïcienne a marqué Tertullien et Grégoire de Nysse. La théorie d'Aristote a exercé son influence que la tradition rabbinique et antiochienne. Cf. l'exégèse d'Ex. 21,22 (LXX) où la peine encourue par celui qui a fait avorter une femme accidentellement est différente selon que l'embryon est formé ou non. En Occident, Augustin adopte le traducianisme de Tertullien pour combattre les pélagiens. Mais le pape Anastase II remet en valeur le créationnisme qui s'impose désormais en Occident. Jusqu'à Thomas d'Aquin, le moment de l'animation sera fixé, avec Aristote, au 40e jour. À la suite de Grégoire de Nysse, Maxime le Confesseur met en lumière l'unité de l'âme et du corps et, par conséquent, leur apparition simultanée au moment de la conception.

Abstract

Ectogenesis, the gestation of the foetus outside of the human body, will not for much longer be in the realm of science fiction; a number of projects attempting to develop ectogenetic technology are currently under way. This book examines the ethical implications of the development of ectogenesis. Examining the implications for abortion ethics in particular, this book also deals with the ethical objections to developing such a technology and the uses to which it may be put, such as creating embryos to supply donor organs for transplantation. The development of the artificial uterus may well be similar to cloning: a sudden technological advance with dramatic ethical implications, thrust suddenly into the public eye.

This project ascertains whether there might be a risk of infertility patients being exposed to insufficiently tested procedures and to see if there is a need for fundamental research in this area. It also looks at the legislative safeguards that exist in Europe. Assisted conception is an area where it often seems that all the ethical and legal issues have been covered and then technology advances and the discussions start all over again. The book is an anthology of papers presented during a project looking at therapeutic research in assisted conception (TRAC). It is divided into three areas addressing research, ethics and law. Each chapter begins with an overview of the issues, with the aim being to present new perspectives rather than covering old ground. The European Convention on Human rights and Biomedicine came into force on December 1, 1999. The Convention allows therapeutic research and research on spare embryos but forbid fundamental research, which may be essential to the safe development of new techniques. this also means that people may become part of an experimental process without their consent. The project brings together clinicians, embryologists, lawyers and ethicists to ascertain whether there might be a risk of infertility patients being exposed to insufficiently tested procedures and to see if there is a need for fundamental research in this area. It also looks at the legislative safeguards that exist and whether a European standard for treatment should be set.
